Terms of business

Terms of Business Effective from: 01 January 2023 (Updated version: May 2025)

Paragliding is an outdoor activity that depends heavily on weather conditions, particularly natural wind. The safety of all participants in a tandem flight is of the highest importance. Therefore, Tandemski poleti Ambrož Mikelj s.p., Lopata 59/A, 3000 Celje (hereinafter referred to as the Organiser) reserves the right to postpone or cancel any flight due to adverse weather conditions.

Responsibility of participants (passengers)

  • Passengers must be in good physical and mental health. Minimum take-off weight: 30 kg | Maximum take-off weight: 120 kg.
  • Passengers must respect the natural environment: no littering, plant picking, or disturbing wildlife.
  • All passengers are treated equally without discrimination.
  • Passengers must treat other people’s property responsibly (e.g., transportation vehicles, flight equipment).
  • In case of intentional damage or loss, the passenger agrees to cover all incurred repair or replacement costs, as assessed by the Organiser based on supplier quotations.
  • Passengers must not engage in actions that endanger themselves or others.
  • The use of alcohol, psychoactive substances, or intoxicants before or during the flight is strictly prohibited.
  • Passengers must arrive at the agreed meeting point at the scheduled time. If late (except in cases of force majeure), the flight is considered to have been carried out.
  • Passengers must follow all pilot instructions given by the Organiser.
  • Failure to comply with these responsibilities may result in flight cancellation without refund.

Health Conditions and Pregnancy

Passengers must disclose the following conditions when booking:

  • Pregnancy
  • Heart disease or high blood pressure
  • Bone conditions (e.g., osteoporosis, arthritis), joint dislocations
  • Epilepsy, neurological conditions
  • Functional impairments (e.g., disabilities, blindness, deafness, mental illness)

These conditions do not automatically exclude participation, but require prior consultation with the Organiser and potentially a doctor’s opinion. Flight adjustments may be made.

Responsibility of the organiser

  • Requested flight dates are considered provisional.
  • The Organiser will confirm the exact flight time at least one day before the preferred date.
  • If weather conditions are unsuitable, the Organiser will offer an alternative flight date and notify the passenger promptly.
  • Flight duration is approximate and intended for general guidance only.
  • The Organiser is only responsible for transport directly related to the tandem flight.
  • The Organiser is not responsible for any incidents occurring outside the flight duration (before take-off or after landing).

Booking

  • Flights can be booked via the Organiser’s website, email, phone, or in person.
  • Website bookings require prepayment.
  • Gift voucher holders may book via email, phone, or in person.
  • A confirmed booking constitutes a binding contract, a booking certificate, and confirmation of agreement with these Terms and Conditions.

Gift voucher

  • Gift vouchers can be purchased via the website, email, phone, or in person as a form of prepayment.
  • Vouchers cannot be exchanged for cash.
  • Validity: 1 year from the purchase date stated on the voucher.

Cancellations

Passenger-initiated cancellations:

The passenger bears all cancellation-related costs:

  • More than 72 hours (3 days) before the flight: Full refund of the prepayment.
  • Less than 72 hours (3 days) before the flight: No refund.

Prepayments per flight:

  • Vogel flight: Total price €190 | Prepayment €40
  • Vogar flight: Total price €130 | Prepayment €30

Organiser-initiated cancellations (e.g., due to weather or safety reasons):

  • Passengers will receive a full refund or the option to reschedule the flight.
  • Refunds are processed in the same payment method used for prepayment. Processing time may take up to 7 business days.

Pricing

  • The price published on the Organiser’s website at the time of booking is valid.
  • All prices are in EUR and include VAT.
  • The Organiser reserves the right to change prices or services. Any changes will be published in advance on the website and take effect the following day.

Payment Methods

  • To secure a reservation, prepayment is required.
  • The remaining balance must be paid after the flight, either by card or in cash.
  • Prepayment options: Online payment (Mastercard, Visa) via our website.
  • Post-flight payment: Cash or card (Mastercard, Maestro, American Express, V Pay, Visa).
  • Gift vouchers can be paid via pro forma invoice.

Insurance & Liability

  • Passengers are insured during the tandem flight (from take-off to landing) with third-party liability coverage up to €1,500,000.
  • Passengers must follow pilot instructions. Failure to do so voids the Organiser’s responsibility.
  • Passengers must ensure adequate personal health insurance covering events before take-off and after landing.

Complaints

  • Complaints may be submitted via the Organiser’s email, phone, or in person.
  • Complaints will be processed in line with the Consumer Protection Act.
  • Passengers will receive outcome notifications within the legally required timeframe.
  • The Organiser is not responsible for damages resulting from passenger failure to comply with Section 1.

Personal Data Protection & Cookies

  • By booking a flight, passengers consent to personal data processing for booking, communication, and flight arrangements.
  • Passengers are responsible for providing accurate data.
  • Data is processed in accordance with EU GDPR regulations.
  • Passengers may request data correction, deletion, or access via email: info@kumulusparagliding.com.
  • When using the Organiser’s website, non-personal data (IP address, access time, browser details) may be collected for analytics and service improvement.

Copyright Notice

  • The Organiser owns all names, trademarks, slogans, and website elements.
  • Website content is protected under intellectual property law.
  • Copyright infringement will be pursued legally.

Validity

  • These Terms and Conditions apply from 01 January 2023 until updated.
  • Any changes will be published on the website and take effect the following day
